TERMS AND CONDITIONS OF SALE

The purpose of these General Terms and Conditions is to define the conditions of use of the site by users. These general conditions form a contract between Scene By Chloe and the user. Scene By Chloe advises its users to read the general conditions of www.scenebychloe.com or 'the website'. You will thus have all the necessary information and will have taken note of the clauses that you have accepted. By visiting this site and/or purchasing one of our products, you agree to accept and be bound by the general conditions of sale.  

Scene By Chloe reserves the right to change these terms and conditions at any time.

1. ACTIVITY

1.1 Ethos

Scene By Chloe is an e-commerce website that offers a selection of second-hand/vintage interior design objects. Scene by Chloe also offers an interior decoration/set design service for individuals or professionals (events, pop-up stores…) as well as a rental service of vintage decoration objects.  The objects offered for rent are those presented for purchase on the site.

2. PRODUCTS AND SERVICES

2.1 Second-hand/vintage pieces

Scene by Chloe provides second-hand/vintage pieces which are available in limited quantities. We have done our best to display as clearly as possible the colours and images of our products that appear on our website. We cannot guarantee that the display of colours on your computer screen will be accurate. We reserve the right but are not obligated, to limit sales of our products to any person in any geographic area or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services we offer. All product descriptions and product prices are subject to change at any time without prior notice; at our sole discretion. The products sold by Scene By Chloe are second-hand, so it is possible that these products may show slight traces of wear or slight physical defects due to their previous lives (e.g. loss of paint, small chips…). We guarantee a selection of products in good condition and take care in cleaning each second-hand item before it is put on sale.  

2.2.  Our Rental Service

Scene By Chloe products are available for rent while stocks last. A deposit is required before being eligible to rent our products. Rented items will be suspended from purchase during the rental period.

3. PRICE AND PAYMENT

3.1 Prices

Scene By Chloe determines the price of its items freely. The prices indicated on the Scene By Chloe website are in GBP including all taxes unless otherwise specified and are those in force at the time of the contract between the seller and the buyer. The prices indicated exclude delivery costs which will be charged in addition to the price of the final order.  All payments must be made in GBP (£). Scene By Chloe reserves the right to change the price of its products at any time.    

3.1 Duties and Taxes

All orders outside of the UK may have additional charges added to the price (custom duties, local taxes, import duty, state tax), the buyer is responsible for all necessary declarations and charges.  Scene by Chloe will not be responsible for any of these additional costs.  Scene By Chloe strongly advises its buyers to check with their dedicated local services in order to anticipate any undesirable costs.  

3.2 Payment

The transfer of the order from the seller to the buyer will only take place once Scene By Chloe has received full payment from the buyer. The price of the product invoiced will be the one displayed on our website at the time of the validation of the order, subject to availability. An order may be refused if the buyer’s credit card is refused or for other reasons that Scene By Chloe will not take the time to explain to the user.  Scene By Chloe cannot be held responsible for any refusal. Payment can be made either by credit card via the secure Shopify payment gateway or via PayPal.

4. ORDERS

4.1 Ordering via our website

When the buyer validates their order on our website, the customer should be fully aware of the present general terms and conditions of sale without exception or reservation. Scene by Chloe reserves the right to refuse an order if there have been previous disputes, non-payment with the buyer, or in case of unavailability of the product. If a product is unavailable, Scene By Chloe will notify the user.  A refund will be issued automatically in this instance. Throughout the entire shopping process, the user can view, add or remove products from the shopping cart.  The confirmation of the order by the buyer is a guarantee of signature and acceptance of the operations carried out. Once the order has been placed, the buyer will receive a summary of the purchase(s) by email via the address of the order confirmation.

5. RETURNS

5.1 Returning/Cancelling

Please ensure you are fully committed to your item ahead of purchase as returns are not accepted. If however the item has not yet been shipped, we will be able to cancel the order. The buyer must contact the Scene by Chloe team and a full return will be issued if the package has not already been dispatched.

5.2

If the item is lost or damaged in transit to the customer, please contact Scene By Chloe, stating the order number and providing images of the damage. We will issue a full refund including postage and packaging to compensate you.

6. AVAILABILITY

6.1 Available Products

The products of Scene By Chloe are offered as long as they are visible on our website and are within the limits of available stock. In case of unavailability of a product, after a customer has placed an order, we will inform them by email. The customer's order will be automatically cancelled and no bank debit will be made. If a bank debit or Paypal payment has been made, it will automatically be refunded by the same means of payment used.  

6.2 Rented Products

One or more Scene By Chloe products may be rented for a period of time determined by a third party, they will then be suspended from purchase, then put back on sale when they are returned.

7. DELIVERY

7.1 Delivery Process

Scene by Chloe occasionally delivers to England and Worldwide. Orders are shipped to the address provided by the buyer, which is on the electronic invoice issued upon confirmation of their order. During the validation of the order, the buyer will be informed of the delivery time as well as the cost of delivery according to his geographical location. The deadlines indicated on our website are given for information only and are not contractual, as they may vary. Packages are shipped on Mondays and Fridays. The package will be delivered to the address indicated during the ordering process.  If there is a delay, an email will be sent to the buyer to notify him/her.  Any problem, or delay in transport, is not the responsibility of Scene By Chloe. It will be up to the buyer to protest the postal service.

7.2 Taxes and Duties

All orders outside of The United Kingdom may have additional charges added to their price (customs duties, local taxes, import duty, state tax), the buyer then becomes the imported of his order and will be responsible for all necessary declarations and charges.  Scene By Chloe will not be responsible for any of these additional costs.  Scene By Chloe strongly advises its buyers to check with their dedicated local services in order to anticipate any undesirable costs.  Upon receipt of the products, the buyer will check the conformity of the products with their initial order.  Once the order has been received the buyer must report any anomaly (missing and/or broken product) via the contact form on the day of receipt of the package, or at the latest one working day after receipt.
